These Terms & Conditions ("Agreement") are entered into by and between Success Express Coaching & Consulting ("Company," "we," "us") and the purchaser or participant ("Client," "you") as of the date of purchase.
By enrolling in SURGO™, you agree to the following terms:
1. Program Overview
SURGO™ is a structured leadership development program consisting of digital training modules, group Office Hours sessions, and optional private executive coaching sessions depending on the tier selected.
Program tiers may include:
* Standard (Module 1 only, no private coaching)
* Premium (Modules 1–3 plus three (3) private coaching sessions)
* VIP (Modules 1–3 plus ten (10) private coaching sessions)
Client acknowledges that access to the SURGO™ digital platform and materials is granted immediately upon purchase and constitutes delivery of digital goods and services.
The Company reserves the right to update, enhance, modify, or improve program materials at any time to maintain quality and relevance.
2. Platform Access
Access to the SURGO™ digital platform is granted for a minimum of three (3) years from the purchase date, or for as long as the program remains commercially available, whichever is longer.
The Company may retire, replace, or decommission program materials after this minimum access period.
Access does not include ongoing private coaching beyond the sessions included in your selected tier.
3. Payment Terms
You agree to pay the full program fee associated with your selected tier.
By selecting a payment plan, you are entering into a binding financial agreement for the full program fee.
If you select a payment plan:
* You authorize scheduled payments to be processed automatically.
* You remain responsible for completing all scheduled payments.
* Non-participation does not void payment obligations.
If a refund is approved under Section 7, any remaining unpaid installments will be cancelled.

4. Private Executive Coaching Sessions (Premium & VIP Only)
Retail Value:
For clarity and refund calculation purposes, each private 1:1 executive coaching session is assigned a retail value of **$750 per session**.
Expiration:
* Premium Tier (3 sessions): Sessions expire nine (9) months from purchase date.
* VIP Tier (10 sessions): Sessions expire twelve (12) months from purchase date.
Unused sessions expire automatically after the applicable period.
Scheduling & Cancellation:
Sessions may be rescheduled with at least twenty-four (24) hours’ notice.
* Sessions cancelled with less than 24 hours’ notice will be considered delivered.
* Failure to attend a scheduled session without notice will be considered delivered.
* Sessions attended, cancelled with insufficient notice, or missed without notice are considered delivered for refund calculation purposes.
* Repeated rescheduling or late cancellations may result in a requirement of seventy-two (72) hours’ notice for future sessions at the Company’s discretion.
Sessions considered delivered are non-refundable.
5. Office Hours & Group Sessions
Office Hours sessions are provided as a group-based support mechanism. Attendance is voluntary but may be required to qualify for refund eligibility.
Office Hours are provided at the Company’s discretion and subject to scheduling availability. The Company does not guarantee specific frequency or availability beyond commercially reasonable efforts.
6. No Performance Guarantee
SURGO™ provides strategic leadership development tools and advisory support. The Company does not guarantee specific results, income levels, promotions, business growth, or organizational outcomes.
You acknowledge that results depend on personal engagement, decision-making, implementation, and external variables beyond the Company’s control.
7. 120-Day Implementation-Based Refund Policy
The Company offers a 120-day conditional refund policy designed to support full and good faith participation.
Refund Window:
Refund requests must be submitted in writing within one hundred twenty (120) days of the purchase date.
Refund requests must be submitted via email to the Company’s official support email address (coachkirby@successexpresscoaching.com) and must include all required supporting documentation at the time of submission. Refund review may take up to fourteen (14) business days.
Eligibility Requirements: To qualify for a refund, you must demonstrate:
1. Completion of all core modules included in your tier.
2. Submission of all required worksheets and exercises.
3. Attendance at a minimum of six (6) Office Hours sessions.
4. For Premium and VIP tiers: use of at least fifty percent (50%) of included private coaching sessions.
5. Written documentation demonstrating good faith implementation of SURGO™ frameworks in real leadership situations.
6. All payments must be current and in good standing.
Failure to meet any eligibility requirement voids refund eligibility.
Refund requests must include supporting documentation evidencing the above participation.
Refund Calculation:
If approved:
* Standard Tier: Full amount paid will be refunded.
* Premium and VIP Tiers: Refund equals total amount paid minus $750 for each private coaching session delivered or considered delivered prior to refund approval.
Private coaching sessions are non-refundable once delivered or considered delivered under the cancellation policy.
The Company reserves the right to deny refund requests that do not meet the stated eligibility criteria.
8. Intellectual Property
All program materials, frameworks, content, recordings, and methodologies are proprietary intellectual property of Success Express Coaching & Consulting.
You may not reproduce, distribute, share, modify, or create derivative works without prior written consent.
9. Limitation of Liability
To the maximum extent permitted by law, the Company shall not be liable for indirect, incidental, consequential, or special damages arising out of participation in SURGO™.
Total liability shall not exceed the total fees paid by you within the twelve (12) months preceding any claim.
10. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Indiana, without regard to conflict of law principles.
Any disputes arising under this Agreement shall be resolved in the appropriate courts located in Indiana.
11. Entire Agreement
This Agreement constitutes the entire agreement between the parties and supersedes all prior communications, representations, or understandings.
Client agrees to contact the Company directly to resolve any concerns prior to initiating a payment dispute or chargeback with a financial institution.
By completing your purchase, you acknowledge and agree to these Terms & Conditions electronically, and such electronic acceptance constitutes a legally binding agreement.
